1. Introduction

Welcome to Continium ("Continium", "we", "our", or "us"). These Terms of Service ("Terms") govern your access to and use of our website, applications, and related services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility & Accounts

• You must be at least 18 years old (or the age of legal majority in your jurisdiction) to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
• You agree to provide accurate, current, and complete information and to keep it updated.
• We may suspend or terminate accounts that violate these Terms, misuse the Service, or pose a security risk.

3. Nature of the Service (AI & Simulation Disclaimer)

No Professional Advice: The Service is provided for informational and general guidance purposes only. Continium is not a financial, medical, legal, mental health, or other professional advisor. You should not make life-altering decisions solely based on the Service. Always consult qualified professionals where appropriate.

User Judgment: You are solely responsible for your decisions, actions, and outcomes. You agree that you will use the Service at your own discretion and risk.

4. Acceptable Use

You agree not to misuse the Service. You must not, and must not attempt to:

• Break the law or encourage illegal activity.
• Upload or share content that is unlawful, harmful, abusive, harassing, hateful, or discriminatory.
• Attempt to gain unauthorized access to systems, accounts, or data (including scraping or probing).
• Reverse engineer, decompile, or attempt to discover source code or underlying models (except where legally permitted).
• Disrupt, overload, or interfere with the Service (e.g., automated requests, abuse, DDoS, bots).
• Use the Service to generate malware, phishing, or other harmful content.

We may investigate violations and suspend or terminate access if we reasonably believe you violated these Terms.

5. Subscriptions, Billing & Trials

Continium may offer paid subscription plans (e.g., Starter, Pro, Power). Payment processing is handled by our payment processor (e.g., Stripe). By subscribing, you agree to:

• Pay the recurring fees and applicable taxes associated with your chosen plan.
• Provide a valid payment method and authorize us/our processor to charge it on a recurring basis.
• Subscriptions auto-renew unless you cancel before the renewal date (typically at least 24 hours prior).
• Trial periods may convert to paid subscriptions automatically unless canceled before trial ends.
• We may change prices or plan features with reasonable notice (as required by law).

Refunds: Refund eligibility (if any) is described in our Refund & Cancellation Policy or as required by applicable law.

6. Content You Provide

You may provide inputs such as text, preferences, goals, or other information ("User Content") for the Service to process. You retain ownership of your User Content.

By submitting User Content, you grant Continium a limited, worldwide, non-exclusive license to host, store, process, and use it solely to provide, maintain, and improve the Service (including generating outputs requested by you), in accordance with our Privacy Policy.

You represent that you have the right to provide the User Content and that it does not infringe the rights of others.

7. Intellectual Property

The Service, including its software, design, branding, and underlying technology, is owned by Continium and protected by intellectual property laws. These Terms do not grant you any ownership rights in the Service.

You may not copy, modify, distribute, sell, or lease any part of the Service unless we give you written permission.

8. Third-Party Services

The Service may integrate or rely on third-party services (e.g., payment processors like Stripe, analytics providers, AI model providers, voice providers). Your use of those services may be subject to their own terms and policies.

We are not responsible for third-party services and do not guarantee their availability, accuracy, or reliability.

9. Availability, Changes & Beta Features

We may update, change, suspend, or discontinue any part of the Service at any time, including features, models, and pricing. Some features may be offered as beta/experimental and may be unstable or incomplete.

We do not guarantee that the Service will be uninterrupted, error-free, or always available.

10. Termination

You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access immediately if we reasonably believe you violated these Terms, created risk, or misused the Service.

Upon termination, your right to use the Service ends. Certain sections of these Terms will survive termination, including Intellectual Property, Disclaimers, Limitation of Liability, and Indemnification.

11. Disclaimer of Warranties

To the maximum extent permitted by law:

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. We disclaim all warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that outputs are accurate, complete, or suitable for your needs.

12. Limitation of Liability

To the maximum extent permitted by law:

Continium and its founders, employees, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.

In any case, our total liability for any claim will not exceed the amount you paid to Continium in the 3 months preceding the event giving rise to the claim (or €50 if you have not paid anything), unless applicable law requires otherwise.

13. Indemnification

You agree to indemnify and hold harmless Continium and its team from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.

14. Governing Law

These Terms are governed by the laws of Albania, and where applicable, relevant European Union consumer protection laws. Conflict of law rules do not apply.

If you are a consumer in the EU/EEA, you may have mandatory rights in your country of residence that cannot be waived.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., in-app notice or email). Continued use of the Service after the effective date means you accept the updated Terms.
